Terms and Conditions

General Provisions


These Conditions are only valid between the company ROUGE HZ LLC. with registered office at 505west 43Rd street, New York, hereinafter referred as “ROUGE HZ LLC” and any person making online purchases on the website www.laporpora.com it hereinafter referred as “CUSTOMER”. These conditions can equivalent to the date of entry into force.

These terms and conditions governing purchases on www.laporpora.com site, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Leg. n. 206/2005, as amended by Legislative Decree no. n. 21/2014 and the Leg. 70/2003 regarding electronic commerce.


ARTICLE 1 - Purpose of the contract


With these general conditions of sale, ROUGE HZ LLC sells and buys CUSTOMER remotely movable tangible property shown and offered for sale on the site www.laporpora.com. The contract concludes exclusively through the Internet, by accessing the CUSTOMER at www.laporpora.com  and implementation of a purchase order in accordance with the procedure provided by the site itself.

The client agrees to inspect prior to confirmation of your order, the present general conditions of sale, in particular the pre-contractual information provided by ROUGE HZ LLC and accept them by affixing a flag in the indicated box.

In the e-mail confirmation of the order, the CUSTOMER will also get the link to download and store a copy of these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.


ARTICLE 2 – Pre-contractual information for consumers – art. 49 of Legislative Decree 206/2005


The CUSTOMER before the conclusion of the purchase contract, examines the type of goods that are described in the individual product data sheets at the time of choice by the CUSTOMER. Before the conclusion of the purchase contract, and before the validation of the order with “payment obligation”, the CUSTOMER is informed regarding:

– The total price of goods inclusive of taxes, with the details of shipping and any other costs;

– Method of payment;

– The period within which ROUGE HZ LLC  is committed to deliver the goods;

– Conditions, terms and procedures for exercising the right of withdrawal (Art. 6 of these conditions) as well as the model withdrawal form in Annex I, Part B of the Legislative Decree 21/2014;

– Information that the Client will have to bear the cost of returning the goods in case of withdrawal;

– Existence of a legal guarantee of conformity for goods purchased;

– Conditions of after sales service and commercial guarantees provided by ROUGE HZ LLC.

ARTICLE 3 – Conclusion and effectiveness of the contract


The sales contract is considered concluded with the sending by ROUGE HZ LLC. to the CUSTOMER an e-mail order confirmation. The e-mail contains the CUSTOMER data and the order number, the price of goods purchased, shipping costs and delivery address to which the goods will be sent and the link to be able to print and store the copy of present conditions.

The CUSTOMER agrees to verify the correctness of the personal data it contains, and to promptly notify ROUGE HZ LLC. corrections.

ROUGE HZ LLC. is committed to describe and present the items sold on the site as well as possible. Nevertheless, some may result from errors, inaccuracies or small differences between the site and the actual product. In addition, of the products featured on do not constitute part of a contract, as only representative.

ROUGE HZ LLC undertakes to deliver the goods within 30 days commencing from sending ROUGE HZ  e-mail of order confirmation to the CUSTOMER.


ARTICLE 4 – Availability of products


The availability of the products refers to the actual availability at the moment when the CLIENT places the order. This availability must still be deemed to be indicative because, owing to the simultaneous presence of multiple users on the site, the products could be sold to other CUSTOMERS before confirming the order.

Even after sending the e-mail order confirmation sent by ROUGE HZ LLC, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically adjusted with the elimination of the product unavailable and the CUSTOMER will be notified immediately via e-mail.

If the CUSTOMER requires the cancellation of the order, resolving the contract, ROUGE HZ LLC refund the amount paid within 14 days from the day ROUGE HZ LLC has knowledge of the customer’s decision to terminate the contract.


ARTICLE 5 – Prices


All the selling prices of the products indicated on www.laporpora.com site are in U.S. dollars and include Tax (VAT).

The shipping costs are not included in the purchase price, but they are indicated and calculated at the conclusion of the buying process before payment.

The CUSTOMER accepts the right to ROUGE HZ LLC to modify its prices at any time, however, the goods will be invoiced based on the prices listed on the site at the time the order is created and listed on the booking confirmation sent by the ROUGE HZ LLC.

In the event of a computer error, manual, technical, or of any other nature that may lead to a substantial change, not provided by ROUGE HZ LLC, the selling price to the public, which makes it unreasonable or clearly insignificant, the purchase order will be considered invalid and canceled and the amount paid by the Client will be refunded within 14 days. from the day of cancellation.


ARTICLE 6 – Right of withdrawa


Pursuant to and for the effects of the Consumer Code, as amended by Legislative Decree no. 21/2014, the customer is given the opportunity to exercise the right of withdrawal, without penalty and without giving any reason, within 14 days schedule of delivery of the goods purchased. To exercise this right, the customer must send, within the time specified, an email  or a letter by registered letter, in which their data are indicated, Name, Last Name, Address , order Number, telephone, description of / the product/s, if any IBAN and owner of the account where you are asked to make the transfer for the refund.

Upon the dispatch of such communication, the CUSTOMER must send, at their own expense and with a courier of their choice, the product you intend to return, including in shipping a module (see below) with your data that must be the same as those posted in communication to exercise the right of withdrawal.

The direct cost of returning the product are charged to the CUSTOMER. The cost is estimated to be equal to a maximum of about 30.00 (thirty/00) u.s. dollars. The returned product must be received by ROUGE HZ LLC within a maximum of 14 calendar days from the date on which you communicate your withdrawal. Once we receive the returned product, ROUGE HZ LLC proceed, to reimburse the price paid for the product/s for which he has exercised his right of withdrawal within 14 calendar days from the date on which you reported the decision of withdrawal, as long as the asset to which the withdrawal is received by the company, or has been provided unequivocal proof of delivery by courier.

The customer is responsible, and therefore not compensable, for the decrease in value of assets resulting from a different manipulation that strictly necessary to establish the nature and characteristics of the good. For personal use products, for hygienic and health reasons it is not possible to return products already in use.


All the risks associated with transporting the product returns are charged to the customer. The goods must be returned intact in its original packaging, complete in all its parts (including packaging and any accessories) and complete the attached tax records. Without prejudice to the right to verify compliance with the above, ROUGE HZ LLC will refund the amount of products covered by the withdrawal within a maximum period of 14 days, including any shipping costs. According to art. 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, ROUGE HZ LLC can suspend redemption until receipt of the goods or until the system demonstration by the CUSTOMER of having sent back the goods to ROUGE HZ LLC.

ROUGE HZ LLC perform reimbursement using the same means of payment chosen by the CUSTOMER during the purchase. In the case of debit or cash, and if the CUSTOMER intends to exercise its right of withdrawal, shall provide to ROUGE HZ LLC, by accessing the contact, the bank details: IBAN and BIC SWIFT required conduct of a reimbursement by the ROUGE HZ LLC.

The CUSTOMER may exercise the right of withdrawal even sending any explicit statement containing the decision to cancel the contract or alternatively transmit the model withdrawal form in Annex I, Part B, Legislative Decree 21/2014 (not mandatory) the text of which is shown below:

ARTICLE 7 – Legal Compliance Warranty


In case of receipt of products not complying with orders or defective, the CUSTOMER is entitled to recovery without the expense of conformity by repair or replacement of the product. 


ARTICLE 8 – Delivery Methods


The products will be delivered by courier to the address indicated by the CUSTOMER at the time of the order no later than 30 days. From the date of receipt by the CLIENT e-mail order confirmation sent by ROUGE HZ LLC. 

For everyday order placed on the site www.laporpora.com. it ROUGE HZ LLC emits sale proceeds (consignment note) of the goods shipped. The invoice for the products acquired by private individuals is not output since this is a sales transaction not subject to ‘duty to tax certificate pursuant to Article 22 paragraph 1 No. 1 of Presidential Decree 633 of 1972 and Article 2 of Presidential Decree 696 of 1996. An order summary that has the same tax and legal value of a traditional receipt, is sent to every customer. The invoice is available on request in the order form, then process the order, the CUSTOMER will receive the invoice by email. The invoice will contain the information provided by the CUSTOMER during the purchase process. After the issuance of the invoice, you can not make any changes to the data indicated in the same. It is not possible to request an invoice after you complete the order without having filled the appropriate “Tax(VAT)” field.


ARTICLE 9 – Liability


ROUGE HZ LLC assumes no liability for disruptions caused by force majeure or unforeseeable circumstances, even if employees from malfunctions and disruptions of the Internet, if it is unable to execute the order within the time stipulated in the contract.


ARTICLE 10 – Access to the site


The CUSTOMER has the right to access the site for inspection and of acquisition. any other use, in particular commercial is not allowed, the site or its content. The integrity of the elements of this site, they are sound or visual, and its use remain the property of ROUGE HZ LLC proprietary technology and are protected by intellectual property law.


ARTICLE 11 – Cookies


The www.laporpora.com website uses ” cookies ”. Cookies are electronic files that record information about the navigation of the Client on the website (pages consulted, date and time of visit, etc ..) and allow to ROUGE HZ LLC to offer a personalized service to its customers.

ROUGE HZ LLC inform the customer of the ability to disable the creation of such files, logging into your Internet configuration menu. It is understood that this could prevent the Customer to proceed to ‘on-line purchase.


ARTICLE 12 – Wholeness


These Conditions of Sale are made up of the totality of the clauses that compose them. If one or more provisions of these Conditions of Sale is deemed invalid or declared as such under the law, regulation or following a decision by a court of competent jurisdiction, the other provisions remain in full force and effect.


ARTICLE 13 – Governing Law and Jurisdiction


These Conditions of Sale are subject to US law. Any dispute which is not amicable solution will be subject to the exclusive jurisdiction of the Court of the place of residence or domicile of the Client, if located within the state.

In any case, you can optionally use the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes that arise in the interpretation and execution of these terms of sale.

User Accounts

As a user, you agree that you will provide your accurate full legal name, a valid email address, valid phone number and shipping/billing address at the time of your registration.  Rouge HZ LLC and user have the right to terminate the user agreement without any prior notification. In that case, the company has the sole right to deny user any further access to its account and the website.
Product Stock
La Porpora sell only those products which the company has in stock. If for any reason a user orders a product which is not in stock, the La Porpora representative will contact the user and provide an active status on the item. If the item cannot be procured, the cost of the item will be refunded in full.

All images, designs, icons, texts, photographs, videos and other materials visible on the website is the intellectual property, trademark and/or copyright of Rouge HZ LLC and its subsidiaries, if any. The published content on the website is intended for non-commercial and personal use only. If anyone downloads the contents, it should be for personal use only. It is important to note that La Porpora reserves the right to modify this Agreement at any time. If you do not agree with the terms outlined in this Agreement, you have the option to refrain from using our website.

Shipping & Return Policy

At La Porpora, we strive to provide the highest level of customer satisfaction. If you have any concerns or issues with your purchase, please contact us, and we will do our best to resolve them. Please take note of the following instructions and guidelines.

Returns:

You have 14 days from the date of delivery to return your item(s) to our warehouse for a form of payment refund. Once your return is beyond the 14 day return period, you have a total of 30 days from the date of your delivery for a store credit. Please see below for the steps to initiate a return and the conditions that must be met for an item to be eligible for return.

To initiate a return, please follow these steps:

  1. Place the item you wish to return back into its original packaging.
  2. Include either a copy of the emailed receipt or a separate sheet with your name, email address, and order number.
  3. Indicate your preferred course of action: refund or replacement. If you want a replacement, please specify the desired item.

Please note that returns sent in mailer bags will not be accepted and will be returned to you. Ensure that your package is received within the specified timeframe mentioned below; failure to comply may result in the package being returned to you.

Return Eligibility:

FOR AN ITEM TO BE ELIGIBLE FOR A RETURN, IT MUST MEET THE FOLLOWING CRITERIA:

  1. The merchandise must be in new, unused, and original condition. The product(s) will be inspected upon receipt.
  2. The merchandise must have all the original tags attached and packaging, including the plastic bag and any boxes provided in the original shipment.
  3. Please do not remove manufacturer's packaging on zipper pulls, handles, shoulder straps, and hardware covering. Removing packaging or tags will result in the item being ineligible for return.

Please ensure that the item is returned in the same packaging it was received in. Items will not be accepted if returned in a bag or mailer bag; they must be returned in an apparel box for the return to be accepted.

Please note that we do not accept returns on Perfume, Cosmetics, Soaps, or Body Luxuries.


Return Label Request:

If you prefer to have us provide a UPS return label, please get in touch with us by calling 1-347-273-4939 or emailing us at La porporainfo@ Laporpora.com. Please note that there will be a charge for the return label, ranging from $10 and up, depending on your zip code and package weight. Once we receive your request, we will email you the UPS return label. Kindly print the label, securely tape it onto the box, and take the package to your nearest UPS office.


Returns received after the 30-day return deadline will be returned to the sender at the sender's expense. Credit will not be issued for return shipping charges. Postage due or COD returns will not be accepted and will be shipped back at the sender's expense.

Refunds:

Once we receive your return and approve the condition of the item, we will issue a refund to your original method of payment. Please note that we can only issue refunds on the original payment method. Returns are normally processed within 5-10 business days after arriving at our fulfillment center. Credits usually take 7-10 business days to appear on your credit card statement.

For items that are returned beyond the 14-day window from the time your package was delivered, we have a specific process in place. Once the returned items have been inspected and accepted, we will issue a store credit as a form of refund. This store credit can be redeemed by contacting us via phone, and we will assist you in applying the credit towards your next purchase.

Shipping

We ship Monday thru Friday excluding holidays. We offer FREE standard shipping within the 48 contiguous United States over $100.00. A shipping fee will be added to sales under $100.00. You also have the option of 2nd Business Day or Next Business Day shipping. 2-DAY and Next Day are delivered Monday thru Friday excluding holidays. We do not offer Saturday or Sunday delivery.  In the case of acts of God, adverse weather conditions, mechanical difficulties or delays caused by high volume holiday carrier delays we must defer to our carrier's posted guarantee and thus a package delivery delay will not be refunded. Delays such as this are out of our control and the carrier will not refund the fee, therefore, we cannot refund the fee. The expedited shipping will only be delivered on business days - Monday - Friday excluding holidays. Orders for 2nd Business Day or Next Business Day placed after 12:00 pm EST will be shipped the following business day. UPS is no longer guaranteeing expedited, next day and 2nd day services, therefore there are no refunds for any delay with these services. We offer shipping in Alaska and Hawaii - once your order is received we will contact you if there is an additional charge. 

Expedited Shipping

Please be advised that expedited shipping options are available for orders placed before 12:00 pm EST on business days (Monday - Friday). Orders for 2 Day which is 2 Business Days or Next Day which is the Next Business Day that are placed after 12:00 pm EST on Thursday will be shipped the following business day and will be delivered the business day after that. Please note that while we prioritize the expedited processing of orders, we cannot guarantee your order will ship the same day.

Expedited shipping may experience delays due to factors beyond our control or UPS's control, including but not limited to unforeseen events such as weather or equipment delays. As of March 2020, UPS no longer guarantees certain expedited services. Therefore, shipping charges are non-refundable, even if the shipment does not arrive on the expected date. 


If your order qualifies for free shipping because the order is over the $100.00 requirement and you then return items that result in your purchase going under the minimum free shipping required amount, the shipping charge will then be taken out of your refund.

If you purchase an item at a discount and decide to return it, you are responsible for the return shipping. You can of course ship it back via USPS, UPS or FEDEX. We can email you a shipping label. If we email you a shipping label you will be responsible for the return shipping fee. If you decide to exchange an item that was purchased on sale, you will be charged for shipping back to you.



Shipping Schedule:

Domestic packages are generally dispatched within 24 to 48 hours after receipt of payment on business days if the order is received by noon EDT (M-F, excluding Holidays), and are shipped via USPS and UPS. Your package will have a tracking number. We will email you that tracking number and your item's estimated date of arrival. Your package will be dropped off without a signature unless you request a signature required at delivery or if your package requires it because of the contents value. If a package is delivered with no signature required and there is no one to receive it, it is left up to the driver's discretion whether or not the package will be left. We will let you know if a signature is required when we send you your tracking number.

If we are shipping to a P.O Box, that may extend your shipping time by a few days. We generally do not ship via the US Postal system. We are happy to accommodate you, but it may cause a slight delay.

International shipping - generally ships within a 3 to 5 days of receipt of payment on business days M-F excluding Holidays.

Shipping Fees:

Shipping fees may include handling and packing fees as well as postage costs. Transport fees vary according to total weight, size and value of the shipment and location of delivery. In the event you return your purchase, shipping charges are not refundable.

Packages shipped via Next Day or Second Day expedited service are shipped without our signature packaging, due to the increased weight and shipping box size. If you wish to include signature packaging you must email us before your purchase and we can estimate the up-charge, we do not mark up shipping, we only charge our costs incurred.

Expedited shipping is not always a guaranteed service. Since COVID March 2020, the UPS is not longer guaranteeing some expedited services. We cannot refund shipping charges even if the shipment does not arrive on the expected date if UPS is not qualifying it for a refund.

Cancellations:


We take pride in shipping orders quickly, and many orders are shipped within hours of receiving them. Therefore, we cannot change or cancel an order once it has entered the shipping process. Once the order is out of our possession we cannot cancel your order. Once you receive your order, you may then return the order if you wish. If you refuse your package, you will be charged the appropriate shipping costs.



Non-Deliverable Return Shipments / Refused Shipments

If your order is shipped via UPS or USPS and several delivery attempts are made to deliver your package, delivery is not accepted, and for whatever reason, your package is returned to La Porpora, you will incur the associated costs of that return. There will be the initial delivery cost, the return delivery cost and a 15 % re-stocking fee. Every attempt to accommodate your delivery needs will be made within the guidelines and policies of the delivery company. In the event your package is returned, we have no choice but to charge you for the incurring costs.

If a package goes missing due to an incorrect address provided by you, we cannot be held responsible for the missing package.



Damaged Goods:

If your items arrive damaged, please contact us immediately (within 48 hours of delivery) to allow us the opportunity to investigate the issue. If damaged goods are to be returned for credit, they must be unworn and unwashed, with the original tags attached, and returned to us within 14 days.



Lost or Delayed Packages:

In the event that your package is lost or significantly delayed during transit, please contact us immediately. We will work with the shipping carrier to resolve the issue and ensure that you receive your order as soon as possible. However, please note that we cannot be held responsible for delays caused by circumstances beyond our control, such as weather conditions, UPS delays or customs procedures.


If the tracking information for your package indicates that it has been delivered but you have not received it, please first check with your neighbors or local postal service. Sometimes packages are left with a neighbor or in a secure location. If you are unable to locate the package, please contact us, and we will assist you in filing a claim with the shipping carrier. Once the package is delivered and that is confirmed by UPS, we have no recourse.


Exchanges:

If you wish to exchange an item for a different size, color, or style, please follow the return process outlined above.

Final Sale Items:

Certain items may be marked as "final sale" or "non-returnable" on our website. These items are not eligible for returns or exchanges unless they are received in a damaged or defective condition. Please review the product description carefully before making a purchase.

Final sale– Items listed as Final Sale - are a Final Sale! Returns, Exchanges, Price Adjustments, or cancellations will not be permitted. No exceptions! items may not be returned.

Route Shipping Insurance is optional but suggested. It is not a refundable charge.


International Shipping

We ship Internationally to most areas. Shipping rates are displayed at the time of checkout. If your order exceeds our weight or value limitations - (perhaps you purchased multiple items), there may be an additional shipping charge. If this is the case, we will contact you for your approval. International customers are responsible for customs, duties, taxes, brokerage fees and any other charges that may incur on all purchases. We reserve the right not to ship to certain areas.

International orders are shipped without our signature packaging, due to the increased weight and shipping box size. Our international rates are computed by the item weight only, with minimal box size. If you wish for signature packaging you must email us before your purchase and we can estimate the up-charge, we do not mark up shipping, we only charge our costs incurred.

Our shipping times will vary depending on Customs. We cannot control the length of time Customs may hold a package. Accordingly, shipping times are not certain because of possible Custom delays. Custom delays are totally out of our control. Once your package leaves the US postal system our access is limited and we can only update you when the postal system updates us. Generally we do not have extended delays, but it does happen on occasion. International orders are non-returnable and are a final sale.In adherence to our store policy on international shipments, it is imperative to note that once an order has departed our warehouse, it is deemed non-returnable. Regrettably, we are unable to intervene or cancel the shipment during transit. This policy extends to a final sale status, underlining the substantial time and cost investments associated with potential returns, encompassing taxes and customs procedures. Shipping is Free within the US 48- States if your order is $100.00 or more. The $100.00 total is calculated without sales tax and discounts. If you choose expedited shipping there is an extra charge. It varies on the location you are shipping to. Once you enter your shipping information and your order, the charge will be computed for you.


 Yes. We offer UPS Next Day Air and Second Day Air. You will be given the option of Free shipping, UPS Second Day Air and UPS Next Day Air. Please choose the option that works for you and the additional shipping charge will be added to your cart.

Of course! The return is bound by our return policies. As long as the return meets the requirements of our return policy, we will exchange the topper for another color or they can apply the credit to their account. If the recipient would like to exchange it, we will send it Free of charge. A UPS label is included with the package. If that label is used it is a usually a $10.00 charge for use of the label. We will ship it back free of charge.
